Terms of Use for MemoryRemains

These Terms of Use (“Terms”) govern your use of the MemoryRemains iPhone app (the “App”), provided by 3Nsofts (“we,” “us,” or “our”). By downloading or using the App, you agree to these Terms and to Apple's applicable App Store terms. If you do not agree, do not use the App.

1. What MemoryRemains does

MemoryRemains creates a private feed and personal journal from photos and short videos you permit the App to read from Apple Photos. It can organize memories, play media, create on-device title and caption suggestions when supported, and let you add private writing, saved states, and collections.

The App does not provide a public social network, cloud backup for your journal, or a replacement for Apple Photos.

2. Permission to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions. You may not copy, resell, rent, sublicense, reverse engineer, interfere with, or misuse the App except where applicable law expressly permits it.

3. Your photos and writing

You retain ownership of your photos, videos, captions, notes, and other content. These Terms do not transfer ownership of that content to us.

You are responsible for having the right to use the media you make available to the App and for how you use or share any output. MemoryRemains does not upload your library or local journal content to us.

4. Photos access and local storage

You choose whether to grant selected or broader Photos access. You can change that access in iOS Settings, although doing so may limit App features.

Captions, notes, saved states, collections, analysis results, and cached previews are stored locally inside the App, excluded from device backup, and do not sync to another device. Deleting the App removes this local journal data. Your original media remains governed by Apple Photos and is not deleted by uninstalling MemoryRemains.

You are responsible for preserving any writing you do not want to lose. MemoryRemains is not a backup or archival service.

5. On-device suggestions

On compatible devices, the App may use Apple-provided on-device technologies to suggest titles, captions, categories, or other descriptions. Generated suggestions can be inaccurate, incomplete, or inappropriate for the context of a memory. Review and edit suggestions before relying on or sharing them.

Availability and performance may vary with hardware, operating-system version, language, installed models, Photos access, battery, storage, and Apple settings. We do not guarantee that caption generation will be available on every device or for every image.

6. iCloud Photos and connectivity

Media stored in iCloud Photos may need to download through Apple when you browse or play it. Downloads can use Wi-Fi or cellular data according to your system settings. We do not control iCloud Photos availability, download speed, Apple service interruptions, or carrier charges.

7. Free use and Lifetime Unlock

The App may let you prepare a limited number of memories without purchase. The optional Lifetime Unlock is a non-consumable in-app purchase that removes the App's prepared-memory limit for the supported lifetime of the App. It is a one-time purchase, not a recurring subscription.

Price and availability are shown by the App Store and may vary by country, currency, tax, and Apple's pricing rules. Apple processes the transaction. Purchases, billing, refunds, family eligibility, and restoration are governed by Apple's policies and your Apple Account.

You can use Restore Purchase with the same Apple Account to ask Apple to restore an eligible entitlement. Restoration of the purchase does not restore or transfer local notes, captions, saved memories, collections, or analysis.

“Lifetime” refers to continued access to the unlocked App feature while MemoryRemains remains offered and technically supportable. It does not guarantee perpetual availability, compatibility with every future device or operating system, or continuation of any Apple service.

8. Acceptable use

You agree not to:

• use the App in violation of law or another person's rights;
• attempt to bypass purchase verification or access controls;
• disrupt, damage, probe, or interfere with the App or Apple-operated services;
• use the App to create, keep, or share content you do not have a right to use;
• redistribute or commercially exploit the App without written permission.

9. Updates, changes, and availability

We may fix, improve, add, remove, suspend, or discontinue App features. Updates may be required for security, compatibility, or continued operation. We do not promise that the App will always be available, error-free, or compatible with every current or future Apple device, system version, language, or service.

Where required by law, changes affecting purchased functionality will be handled in accordance with applicable consumer-protection rules and Apple's policies.

10. Privacy

Our handling of information is described in the MemoryRemains Privacy Policy. Apple's processing through the App Store, iCloud Photos, Apple Intelligence, and related services is governed by Apple's terms and privacy policy.

11. Disclaimers

To the fullest extent permitted by law, the App is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

MemoryRemains is intended for personal reflection and organization. It is not a professional, medical, mental-health, backup, storage, identity-recognition, or emergency service. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

12. Limitation of liability

To the fullest extent permitted by law, 3Nsofts and its contributors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, memories, profits, or opportunities arising from use of or inability to use the App, Apple services, generated suggestions, or local data loss.

Where liability cannot be excluded, it will be limited to the greater of the amount you paid for the App or the minimum amount required by applicable law. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

13. Termination

You may stop using the App at any time. These Terms terminate automatically if you materially violate them. Upon termination, your license to use the App ends. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

14. Governing terms and consumer rights

These Terms are governed by the laws applicable where the developer is established, without overriding mandatory consumer protections available where you live. Apple's applicable App Store terms also apply. If a dispute arises, please contact us first so we can try to resolve it informally.

15. Changes to these Terms

We may update these Terms as the App or legal requirements change. The updated Terms will show a new effective date. If a material change requires consent under applicable law, we will provide an appropriate notice.
