Terms and Conditions

These Terms govern your use of Stillgrow, an iOS application developed by 3N Softs ("we," "our," or "us"). By downloading or using Stillgrow, you agree to these Terms.

If you do not agree, do not download or use the app. You can request a refund through Apple within their refund window.

1. The license you receive

When you purchase Stillgrow through the App Store, you receive a non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, in accordance with the App Store Terms of Service.

The terms of Apple's End User License Agreement (EULA) also apply and are available at apple.com/legal/internet-services/itunes/dev/stdeula/.

You may not:

  • Reverse engineer, decompile, or disassemble the app, except as expressly permitted by applicable law
  • Modify, adapt, translate, or create derivative works from the app
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the app in any way that violates applicable laws or these Terms
  • Distribute, sell, lease, rent, sublicense, or otherwise transfer the app to any third party

2. What Stillgrow is

Stillgrow is an ambient iOS application that generates visual representations ("plants") based on physiological data from Apple's HealthKit framework or self-reported mood and energy levels. Stillgrow includes:

  • A daily seed mechanic that generates one plant per calendar day
  • A guided breathing session feature called Breath Bloom
  • A persistent garden that accumulates plants over time
  • A memoir feature that displays the context of each plant

Stillgrow is provided as a finished product. While we may release updates and improvements, we do not guarantee any specific features, updates, or support timeline beyond what is required for the app to continue functioning on supported iOS versions.

3. What Stillgrow is not

Medical disclaimer

Stillgrow is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It is not a substitute for professional medical advice, diagnosis, or treatment.

The data Stillgrow displays — including plants generated from physiological signals — is intended for personal interest and contemplative reflection only. Do not use Stillgrow to make medical, mental health, or treatment decisions.

Stillgrow is also not:

  • A meditation training program or therapy app
  • A mental health intervention
  • A fitness tracker or clinical diagnostic tool
  • A wellness coaching service

If you are experiencing a medical or mental health emergency, contact your local emergency services.

4. HealthKit and your health data

Stillgrow can read heart rate variability, resting heart rate, and sleep data from Apple's HealthKit framework if you grant permission. This data is processed entirely on your device and is never transmitted to us or any third party.

You can revoke HealthKit access at any time through iOS Settings. Stillgrow continues to function without HealthKit access using your manually entered mood and energy levels.

We make no claims about the accuracy of HealthKit data. The accuracy of this data is determined by Apple, your Apple Watch, your iPhone, and the conditions under which the measurements were taken.

5. Purchase and refunds

Stillgrow is sold as a one-time purchase through the App Store at $4.99 USD. There are no subscriptions, no recurring charges, and no in-app purchases beyond the initial app purchase.

Refunds are processed by Apple, not by us. You can request a refund through Apple's refund process at reportaproblem.apple.com. Apple's refund policies and timeframes apply. We have no ability to issue or deny refunds.

If you purchased Stillgrow through Family Sharing, the original purchaser controls the purchase. Family members do not need to purchase separately.

6. Disclaimers

Stillgrow is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • Stillgrow will meet your specific requirements
  • Stillgrow will be uninterrupted, timely, secure, or error-free
  • The results obtained from using Stillgrow will be accurate or reliable
  • Any errors in Stillgrow will be corrected

7. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall 3N Softs, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use Stillgrow.

In no event shall our total liability to you exceed the amount you paid for Stillgrow.

8. Intellectual property

Stillgrow, including its name, logo, code, visual design, audio assets, and all associated content, is the intellectual property of 3N Softs and is protected by copyright, trademark, and other applicable laws.

Plants generated by your use of Stillgrow are considered your personal data and are yours to view, screenshot, and share as you wish for non-commercial purposes. The underlying generative system, the visual style, the code that produces the plants, and the broader Stillgrow brand remain the property of 3N Softs.

You may share screenshots of your garden on social media and personal channels. You may not use Stillgrow's visual output, brand, or generative system for commercial purposes without written permission.

9. Updates and changes to the app

We may release updates to Stillgrow that add features, fix bugs, or improve performance. Updates are delivered through the App Store. We may discontinue Stillgrow at any time. If we do, the app will continue to function on devices where it is already installed for as long as it remains compatible with iOS, but no new updates or support will be provided.

10. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated through an in-app notice on the next launch. The updated Terms will be published at 3nsofts.com/stillgrow/terms with a new "Last updated" date. Your continued use of Stillgrow after the updated Terms take effect constitutes acceptance of the changes.

11. Governing law

These Terms are governed by the laws of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Stillgrow shall be resolved in the courts of Antalya, Turkey.

For users in the European Union, this does not affect any mandatory consumer protection rights you have under the laws of your country of residence.

By using Stillgrow, you acknowledge that you have read, understood, and agree to be bound by these Terms.
