Terms and Conditions

1. Acceptance of Terms

By downloading, installing, or using Pictureforge (“the App”), you agree to be bound by these Terms and Conditions. If you do not agree, do not install or use the App. These Terms apply to the macOS version of Pictureforge distributed through the Mac App Store.

2. Licence Grant

2.1 Personal and Business Use

Subject to these Terms, 3nsofts grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Pictureforge on macOS devices that you own or control, for personal or internal business use.

2.2 Number of Devices

A single licence permits installation on Mac computers associated with the same Apple ID used to download the App through the Mac App Store, consistent with Apple's standard App Store terms.

2.3 Restrictions

You may not:

  • Copy, modify, adapt, or create derivative works of the App or any part thereof
  • Reverse engineer, decompile, or disassemble the App, except as expressly permitted by applicable law
  • Remove or alter any proprietary notices, labels, or branding in the App
  • Rent, lease, sublicense, sell, or otherwise commercially exploit the App or your rights under this Agreement
  • Use the App to develop a competing product or service
  • Use the App in violation of any applicable law or regulation

3. The App Is Free

Pictureforge is provided free of charge. There are no in-app purchases, subscription fees, or premium tiers. All features described in the App Store listing are available to all users at no cost.

4. Intellectual Property

4.1 Ownership

The App, including its source code, design, graphics, user interface, and documentation, is the exclusive property of 3nsofts and is protected by copyright and other intellectual property laws. These Terms do not grant you any ownership interest in the App.

4.2 Your Content

You retain full ownership of all images, documents, and creative work you produce, edit, or export using the App. 3nsofts claims no ownership or licence rights over your content. Your files remain on your device under your control at all times.

4.3 Feedback

If you submit feedback, suggestions, or bug reports to 3nsofts, you grant 3nsofts a non-exclusive, royalty-free licence to use that feedback for improving the App. You retain ownership of any specific content in your feedback.

5. AI Features — Accuracy and Appropriate Use

The AI features in Pictureforge (Background Removal, Smart Select, AI Upscale, AI Denoise, Auto Enhance, Saliency Select, and White Balance Correction) are provided as creative assistance tools. These features:

  • May produce imperfect or undesirable results on certain images
  • Are intended for creative photography and design workflows
  • Are not intended for safety-critical applications, medical imaging, forensic analysis, legal evidence preparation, or other contexts where AI errors could cause harm
  • Operate entirely on-device; no images are uploaded to any server

You are solely responsible for reviewing and approving all AI-generated results before using them in any context. 3nsofts makes no warranties regarding the accuracy, completeness, or fitness for purpose of AI-generated outputs.

6. Privacy

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. The App does not collect personal data or transmit your images or files to any external server.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

3nsofts does not warrant that:

  • The App will meet your specific requirements
  • The App will be uninterrupted, error-free, or free of harmful components
  • Any errors in the App will be corrected
  • AI features will produce accurate or suitable results for any specific use case

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 3NSOFTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR DAMAGE TO YOUR IMAGES OR DOCUMENTS — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF 3NSOFTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Because Pictureforge is provided free of charge, 3nsofts' total liability to you for any claim arising under these Terms shall not exceed USD $0.

9. Data Loss

Pictureforge processes image data in memory and implements autosave and macOS Versions via NSDocument. You are solely responsible for maintaining backups of your files. 3nsofts is not responsible for loss of data arising from App crashes, hardware failure, OS errors, or user error.

10. Acceptable Use

You agree not to use the App to:

  • Create, edit, or distribute content that is unlawful, defamatory, threatening, harassing, or otherwise objectionable
  • Infringe any copyright, trademark, patent, or other intellectual property right of any third party
  • Create deepfakes, non-consensual intimate imagery, or manipulated images intended to deceive or harm any person
  • Violate any applicable law or regulation

11. Updates and Availability

3nsofts may release updates to Pictureforge through the Mac App Store. Updates may change, add, or remove features. 3nsofts reserves the right to discontinue the App at any time, though we will make reasonable efforts to provide advance notice of significant changes.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which 3nsofts is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

If you are a consumer in a jurisdiction with mandatory local consumer protection laws, nothing in these Terms limits your rights under those laws.

13. Mac App Store

Your use of the App is also subject to the Mac App Store Terms of Service. In the event of any conflict between these Terms and the Mac App Store Terms of Service, the Mac App Store Terms of Service shall prevail.

Apple is not a party to these Terms and has no obligation to provide any maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted to our website and the “Last Updated” date at the top of this document will be revised. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and 3nsofts regarding your use of Pictureforge, and supersede all prior agreements and understandings.
