Terms of Use

1. Agreement to These Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Ehsan Azish / 3nsofts (“Developer”, “we”, “us”) governing your use of the Lokál application (“App”) on Apple macOS devices.

By downloading, installing, or using the App, you confirm that you are at least 13 years old and agree to be bound by these Terms. If you do not agree, do not use the App.

2. License Grant

Subject to your compliance with these Terms and Apple's App Store Terms of Service, the Developer grants you a personal, non-exclusive, non-transferable, revocable license to:

• –Download and install the App on Apple devices that you own or control.
• –Use the App for lawful personal or professional dictation purposes.

This license does not include resale, sub-licensing, or distribution of the App to third parties.

3. Restrictions

You agree not to:

• –Copy, decompile, reverse-engineer, disassemble, or attempt to derive the source code of the App.
• –Modify, adapt, translate, or create derivative works based on the App.
• –Rent, lease, lend, sell, redistribute, or sublicense the App.
• –Remove, obscure, or alter any proprietary notices or labels within the App.
• –Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• –Use the App to produce content that is defamatory, harassing, harmful, or in violation of third-party rights.
• –Circumvent, disable, or interfere with any security or access control features of the App.

4. Intellectual Property

The App, including its design, code, graphics, name “Lokál”, and all associated intellectual property, is owned by the Developer and is protected by applicable copyright, trademark, and other intellectual property laws.

You retain full ownership of any text you produce using the App. The Developer makes no claim over content you dictate or generate with Lokál.

5. Purchases, Billing, and Refunds

Lokál is sold as a one-time in-app purchase through the Apple Mac App Store. All payment processing, billing, and refund handling is managed exclusively by Apple pursuant to Apple's own terms and policies.

Your purchase includes access to all features available at the time of purchase as well as future App updates distributed through the Mac App Store, for as long as the App is maintained.

6. Updates and Availability

The Developer may release updates that add features, fix bugs, or improve compatibility with new versions of macOS. Some updates may require a more recent version of macOS than previously required.

The Developer reserves the right to discontinue the App at any time. In such an event, previously purchased licenses are not refunded; you may continue to use any previously downloaded version of the App that is compatible with your system.

7. Third-Party Technology

The App uses Apple's on-device Speech Recognition (SFSpeechRecognizer / SFSpeechAnalyzer), Foundation Models (Apple Intelligence), and StoreKit frameworks, which are subject to Apple's own terms. The App does not incorporate any third-party open-source components that impose distribution restrictions.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. In brief: we collect no personal data and process all audio entirely on your device.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

The Developer does not warrant that: (a) the App will be error-free or uninterrupted; (b) transcription results will be perfectly accurate; (c) the App will be compatible with all future versions of macOS or all hardware configurations.

Speech recognition accuracy depends on your microphone quality, accent, ambient noise, and the macOS Speech framework. The Developer is not responsible for errors in dictated content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of data, revenue, profits, or goodwill, arising out of or in connection with your use of or inability to use the App, even if advised of the possibility of such damages.

In jurisdictions where limitation of liability is restricted, the Developer's total liability shall not exceed the amount you paid for the App.

11. Apple End User License Agreement

This App is distributed through the Apple Mac App Store. The parties agree that Apple is not a party to these Terms and bears no responsibility for the App or its content. Apple has no obligation whatsoever to furnish maintenance or support services with respect to the App.

In the event of any conflict between these Terms and Apple's standard EULA for Mac App Store apps, Apple's standard EULA shall govern to the extent of the conflict. You may review Apple's standard EULA at: apple.com/legal/internet-services/itunes/dev/stdeula/

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Developer is domiciled, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall first be addressed by contacting us at support@3nsofts.com. If the dispute cannot be resolved informally, it shall be submitted to the competent courts of the Developer's jurisdiction.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the App after changes are published constitutes acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify users via an in-app notice or the App Store update release notes.
