Please read these Terms & Conditions ("Terms") carefully before downloading or using HobbyIt: Health & Habits (the "App"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User", "you") and 3nsofts ("we", "us", "our") governing your use of the App distributed through the Apple App Store. Your use of the App is also subject to Apple's Standard End User License Agreement (EULA), which is incorporated herein by reference. Your use of the App is also governed by our Privacy Policy, incorporated into these Terms by reference.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes.

You may not:

Copy, modify, or distribute the App or any portion of it.
Reverse-engineer, decompile, or disassemble the App.
Rent, lease, lend, sell, or sublicense the App.
Use the App for any unlawful purpose or in violation of any applicable law.

3. HobbyIt Pro — Subscriptions and In-App Purchases

3.1 Available Plans

The App offers the following paid options, subject to change:

Monthly subscription — access to Pro features billed monthly.
Annual subscription — access to Pro features billed once per year (best value).
Lifetime purchase — one-time payment for permanent Pro access.

Current prices are displayed in the App and are denominated in your local App Store currency. Prices may vary by region and are subject to change.

3.2 Free Tier Limitations

The free tier of HobbyIt allows you to track one hobby and view up to 7 days of statistics. Additional hobbies and extended history (30-day and 90-day views) require an active HobbyIt Pro subscription or a lifetime purchase.

3.3 Billing and Renewal

Subscriptions are charged to your Apple ID at purchase confirmation.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscription at any time in Settings → [Your Name] → Subscriptions on your device.
Cancellation takes effect at the end of the current billing period; you retain Pro access until that date.

3.4 Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple through the App Store. We do not process refunds directly. See Apple's refund policy for more information.

3.5 Restore Purchases

If you reinstall the App or use it on a new device, use the "Restore Purchases" option within the App to recover your existing Pro entitlement. Restoration requires signing in with the same Apple ID used for the original purchase.

4. Health Disclaimer

Important Health Notice

The App is intended for general wellness and habit-tracking purposes only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare professional before starting any exercise, diet, or behaviour-change programme.

Content in the App, including AI-generated coaching tips, is for informational and motivational purposes only. Do not disregard professional medical advice or delay seeking it because of anything you read or see in the App.

5. HealthKit Integration

With your permission, the App integrates with Apple HealthKit to read and write fitness and health data. You are responsible for ensuring that your use of HealthKit data complies with applicable laws. We are not responsible for the accuracy of data sourced from HealthKit or third-party devices.

6. AI-Generated Content

Some coaching tips may be generated using on-device AI models (Apple Foundation Models framework). AI-generated content is provided "as is" without any warranty of accuracy, completeness, or fitness for a particular purpose. You should use your own judgement before acting on any AI-generated recommendation.

On-Device AI Processing

All AI coaching tip generation occurs locally on your device. No personal data is transmitted to external AI servers or third-party APIs.

7. Intellectual Property

The App, including its design, graphics, code, and content, is owned by 3nsofts and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

8. User Content

All habit entries, logs, and data you create in the App are stored locally on your device. You retain ownership of your content. By using the App you represent that you have the right to store any content you input.

9. Acceptable Use

You may not use the App to:

Violate any local, state, national, or international law.
Infringe upon the intellectual property rights of others.
Attempt to reverse-engineer, decompile, or hack the App.
Use the App in any way that could harm, disable, or impair our services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

Important Legal Notice

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 3NSOFTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless 3nsofts and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the App or violation of these Terms.

13. Third-Party Services

The App relies on Apple services including the App Store, StoreKit, HealthKit, and on-device Foundation Models. Your use of those services is subject to Apple's own terms and privacy policies. We are not responsible for the availability or terms of any Apple service.

14. Changes to the App or Terms

We reserve the right to modify, suspend, or discontinue the App (or any feature thereof) at any time with or without notice. We may also update these Terms; the revised version will be posted at https://3nsofts.com/hobbyit/terms with a new effective date. Continued use of the App after changes constitutes acceptance.

15. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, all licences granted herein immediately cease.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which 3nsofts operates, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

17. Apple EULA

As required by Apple, these Terms incorporate by reference Apple's Standard EULA, available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

In the event of a conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall control with respect to any Apple-specific obligations.

18. Entire Agreement

These Terms, together with our Privacy Policyand Apple's Standard EULA, constitute the entire agreement between you and 3nsofts concerning the App and supersede all prior agreements.
