ECHO Terms of Use

These Terms of Use ("Terms") govern your use of ECHO Survival AI ("ECHO" or the "App"), provided by 3Nsofts ("3Nsofts," "we," "us," or "our"). By affirmatively accepting these Terms or using ECHO, you agree to them. If you do not agree, do not use the App.

1. Important safety notice

ECHO provides general informational suggestions for survival and preparedness situations. Content may be drawn from safety, first-aid, public-health, navigation, and wilderness references, but ECHO has not examined you, your surroundings, or all relevant facts.

ECHO is not an emergency service, search-and-rescue organization, doctor, clinician, poison-control center, weather service, navigation authority, or substitute for trained professional judgment. It does not diagnose, prescribe, or provide individualized medical treatment.

Contact local emergency services first whenever communication is available. Follow instructions from emergency dispatchers, clinicians, rescue personnel, public authorities, product manufacturers, and on-scene professionals over ECHO. Seek qualified medical care in addition to using ECHO and before making medical decisions whenever feasible.

2. AI and information limitations

ECHO uses on-device software and an artificial-intelligence model. AI output can be incorrect, incomplete, ambiguous, outdated, inconsistent, or inappropriate for a particular person or situation. Curated guides can also omit facts or become outdated. A confident or detailed response is not proof of accuracy.

You must independently assess immediate hazards, injuries, symptoms, weather, terrain, available equipment, your skills, local laws, and changing conditions. Verify important information through reliable sources whenever possible. Do not take an irreversible action based only on ECHO when facts are uncertain.

3. Navigation, maps, GPS, and sensors

Offline maps are simplified and may omit or misplace cliffs, trails, roads, water, private property, closures, hazards, boundaries, facilities, elevation details, or recent environmental changes. GPS, compass, altitude, pressure, motion, distance, bearing, and steepness readings may be inaccurate, delayed, unavailable, or affected by hardware, terrain, weather, buildings, magnetic interference, battery state, or permissions.

A direction arrow or straight-line bearing does not establish a safe or lawful route. Do not follow it across cliffs, avalanche terrain, fire, floodwater, unstable ground, restricted areas, or other hazards. Maintain appropriate independent navigation tools and skills.

4. Your responsibilities

You are responsible for:

  • deciding whether ECHO is appropriate for your circumstances;
  • using reasonable judgment and stopping when an instruction appears unsafe;
  • obtaining professional training, medical care, rescue assistance, maps, forecasts, permits, and equipment appropriate to your activity;
  • maintaining device power, protection, connectivity options, and backups;
  • protecting your device and any sensitive information entered into ECHO; and
  • complying with laws, land restrictions, evacuation orders, fire restrictions, and professional instructions.

Do not delay contacting emergency services or seeking professional care because of ECHO. Do not use ECHO to harm anyone, facilitate unlawful conduct, impersonate a professional, or provide unqualified services to others.

5. Eligibility and minors

You must be legally capable of accepting these Terms. ECHO is not directed to children under 13. Minors may use ECHO only with the involvement and permission of a parent or legal guardian where required. A parent or guardian is responsible for supervising a minor's use.

6. License and acceptable use

Subject to these Terms and Apple's applicable rules, 3Nsofts grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use ECHO on Apple devices you own or control for lawful personal use.

You may not reverse engineer, extract, redistribute, resell, rent, bypass purchase controls, interfere with security or integrity checks, misuse download infrastructure, or use ECHO or its model to develop or train a competing model except where such restriction is prohibited by law or permitted by an applicable open-source license.

7. Purchases

Apple processes in-app purchases. Prices, taxes, refunds, family sharing, purchase authorization, and restoration are governed by Apple and applicable law. A displayed one-time unlock grants the functionality described in the App for the supported lifetime of that product; it does not guarantee that every feature, model, device, operating system, or external service will remain available indefinitely.

Mandatory refund and consumer rights are not limited by these Terms.

8. Downloads, updates, and availability

Conversational features may require a large model download, sufficient storage, compatible hardware, and a supported iOS version. Downloads may fail, pause, restart, or become unavailable. Updates may replace or delete superseded model files, change features, correct safety content, or require renewed acknowledgement.

Essential guides, the AI model, maps, or other features may be changed, suspended, or discontinued for safety, legal, security, compatibility, or operational reasons. Do not rely on ECHO as your only emergency plan, communication method, medical reference, map, or store of critical information.

9. Intellectual property and third-party materials

ECHO's interface, original content, code, branding, and compilation are owned by 3Nsofts or its licensors and protected by applicable law. Certain models, libraries, map data, reference materials, Apple services, or linked resources may be governed by separate licenses and terms. Links to independent organizations are provided for verification and education; they do not imply sponsorship, endorsement, or review of ECHO.

10. Privacy

The ECHO Privacy Policy explains data handling and is incorporated into these Terms. Review it before entering personal, health, or location information.

11. Disclaimer of warranties

To the maximum extent permitted by applicable law, ECHO is provided "as is" and "as available." 3Nsofts disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, and that ECHO will be error-free or suitable for an emergency.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded, including mandatory consumer guarantees that apply where you live.

12. Limitation of liability

To the maximum extent permitted by applicable law, 3Nsofts and its owners, personnel, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, opportunity, or goodwill; device or property damage; or claims arising from reliance on AI output, guides, maps, sensors, unavailable communications, or failure to seek professional assistance.

To the maximum extent permitted by law, total liability arising from ECHO will not exceed the greater of the amount you paid for ECHO during the twelve months before the event giving rise to the claim or USD $25.

These limitations do not apply to liability that cannot legally be limited or excluded, which may include fraud, willful misconduct, gross negligence, death or personal injury caused by negligence in some jurisdictions, or mandatory consumer rights. Some jurisdictions do not permit certain exclusions, so parts of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to defend and indemnify 3Nsofts against third-party claims caused by your unlawful misuse of ECHO, violation of another person's rights, or material breach of these Terms. This provision does not apply to claims caused by 3Nsofts or where prohibited by consumer law.

14. Apple terms

Apple is not responsible for ECHO or its content, support, warranties, or claims, except as required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the license terms applicable to the App. Your use must also comply with the Apple Media Services Terms and the App Store's applicable usage rules.

15. Changes and termination

We may update these Terms to address new features, safety findings, law, or service changes. Material changes may require renewed acceptance. You may terminate these Terms by stopping use and deleting ECHO. We may restrict access where reasonably necessary to protect users, enforce these Terms, or comply with law.

Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, and dispute provisions—will survive.

16. Governing rules and disputes

These Terms do not deprive you of mandatory protections or courts available under the consumer law of your residence. Before filing a claim, please contact 3Nsofts through https://3nsofts.com/ with a concise description so the parties can attempt an informal resolution. Any governing law, forum, limitation period, or dispute process imposed by mandatory law remains applicable.

17. Severability and entire agreement

If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed without invalidating the remainder. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, Apple's applicable terms, and any product-specific disclosures form the agreement concerning ECHO.
